§ 1 Contracting parties and scope
(1) These terms and conditions apply to all accommodation contracts and related services between the guest and Nina und Matthias Kienzle GesbR, Nesselwängle 124, 6672 Nesselwängle, Tyrol, Austria, VAT ID ATU83330539 (hereinafter ”the accommodation”).
(2) These terms apply in their version valid at the time. Deviating terms of the guest do not apply unless the accommodation expressly agrees to them in writing.
(3) In addition and subordinately, the Austrian General Terms and Conditions for the Hotel Industry 2006 (AGBH 2006) apply in their current version, insofar as these terms do not provide otherwise. The AGBH are available via the Austrian Economic Chamber.
§ 2 Booking and conclusion of contract
(1) The accommodation contract is concluded upon the written booking confirmation by the accommodation (by email or in text form).
(2) Bookings can be made via the online booking system on www.sunneschloessli.com, by email to welcome@sunneschloessli.com, or by telephone. For telephone and email bookings, the contract is only concluded upon receipt of the written confirmation.
(3) For online bookings, the guest is informed of the total cost and these terms before the binding conclusion. The contract is concluded by clicking ”Book now with obligation to pay” and the confirmation sent thereupon.
(4) If a third party books on behalf of the guest, that party and the guest are jointly and severally liable for all contractual obligations.
§ 3 Rates and scope of services
(1) Rates are in euros and include statutory VAT. The rates shown at the time of booking or stated in the confirmation apply.
(2) The accommodation rate includes: the night in the booked suite, use of the swimming pond, whirlpool, steam bath and the other wellness areas according to the posted opening hours, and access to the common areas.
(3) Breakfast is an additional service and is charged separately according to the valid price list, unless expressly included in the booking.
(4) The visitor’s tax (Ortstaxe) of the municipality of Nesselwängle is charged separately per person and night and is not included in the accommodation rate.
(5) Special services (late check-out, additional cleaning, special arrangements) are agreed and charged separately.
§ 4 Payment
(1) The total amount is due on arrival at the latest, unless agreed otherwise.
(2) For stays of more than three nights or from a total amount of EUR 500.00, a deposit of up to 30% may be required. If it is not paid within the deadline, the accommodation may withdraw from the contract.
(3) Accepted means of payment: cash, bank transfer, debit and credit cards (Visa, Mastercard, American Express and others) and payment link by email. No surcharges are applied to card payments.
(4) In case of late payment, default interest at the statutory rate may be charged.
§ 5 Arrival and departure
(1) Check-in from 3 pm; earlier arrival subject to availability and by arrangement. (2) Check-out by 11 am; late check-out subject to availability and possibly a fee.
(3) On arrival, the guest presents a valid official photo ID; the accommodation is required to record registration data under the Tyrolean Tourism Act. (4) Arrival outside the agreed times must be announced in good time.
§ 6 Cancellation by the guest
(1) Cancellations must be made in text form (email is sufficient). The time of receipt by the accommodation is decisive.
(2) The following cancellation rates apply:

(3) The total price comprises the accommodation rate plus firmly booked additional services; visitor’s tax and levies are not charged in case of cancellation. (4) If the suite can be re-let, the cancellation fee is reduced by the proceeds obtained, minus EUR 30.00 administration costs; there is no legal entitlement to this.
(5) For distance bookings there is no right of withdrawal under the Austrian FAGG (§ 18 para. 1 no. 12 FAGG). (6) Travel cancellation insurance is recommended.
§ 7 No-show
If the guest has not arrived by 10 pm on the day of arrival and has not given prior notice, the booking is deemed cancelled; the full cancellation fee under § 6 is charged.
§ 8 Withdrawal by the accommodation
(1) The accommodation may withdraw if the guest has misrepresented material circumstances, a deposit was not paid on time, an objective reason makes performance unreasonable, or force majeure makes performance impossible. (2) In case of force majeure, payments already made are refunded in full within 14 days.
§ 9 Liability
(1) Liability for items brought in is governed by §§ 970 ff of the Austrian Civil Code (ABGB); the suite safe is recommended for valuables. (2) The accommodation is liable to the full statutory extent for intent, gross negligence and personal injury; liability for slight negligence is excluded to the extent permitted. (3) Use of the swimming pond, whirlpool, steam bath and wellness facilities is at the guest’s own risk. (4) Damage must be reported without delay, at the latest at check-out.
§ 10 House rules
(1) No smoking in all indoor areas; violations incur a flat cleaning fee of EUR 150.00. (2) Quiet hours from 10 pm to 7 am. (3) The suite may only be occupied by the stated number of guests. (4) Children under 14 may use the swimming pond and whirlpool only when accompanied by an adult. (5) External visitors must be announced in advance. (6) Damage caused by the guest is charged at cost.
§ 11 Pets
(1) Pets are welcome if stated at booking and confirmed. (2) They may not enter the common areas, the wellness area or the swimming pond; a lead is required elsewhere. (3) The guest is liable for all damage caused by their animal. (4) Supplement EUR 25.00 per night, on request and confirmation only.
§ 12 Privacy
Personal data is processed in accordance with our privacy policy, the GDPR and the Austrian Data Protection Act (DSG 2018).
§ 13 Applicable law and jurisdiction
(1) Austrian law applies, excluding its conflict-of-law rules. (2) The exclusive place of jurisdiction is the competent court at the seat of the accommodation (Nesselwängle, district of Reutte), to the extent legally permissible. (3) Mandatory jurisdiction provisions of the Austrian Consumer Protection Act (KSchG) remain unaffected. (4) Platform for online dispute resolution: ec.europa.eu/consumers/odr; we do not take part in arbitration proceedings.
§ 14 Final provisions
(1) Should individual provisions be invalid, the validity of the remaining provisions is unaffected. (2) Amendments and additions must be in text form. (3) These terms are available in their current version at www.sunneschloessli.com. In case of doubt, the German version prevails.
